Custom Commission Terms and Conditions


By submitting the Commission Request Form and paying the 50% non-refundable deposit, the Client agrees to the following terms and conditions set forth by Emily Culler (The Artist):


1. Commission Agreement and Pricing


  • Pricing and Quote: All quotes are provided on an individual basis and are determined by the complexity of the subject, the chosen materials (Oil, Acrylic, etc.), and the size of the final artwork.

  • Payment Schedule: A non-refundable deposit of fifty percent (50%) of the total quoted price is required to secure the Client’s spot and begin work. The remaining fifty percent (50%) balance, plus shipping costs, is due upon the Client’s final approval of the completed artwork, prior to shipment.


2. Timelines and Process


  • Timeline: The estimated completion time is 2–4 weeks from the date the deposit is received, though this may vary based on the size, complexity, and the Artist's current workload.

  • Client Check-In: The Artist will send one check-in photo halfway through the painting process for feedback on composition and color.

  • Final Approval: A final photo will be sent for approval. Upon receiving written confirmation of final approval, the artwork is considered complete, and the remaining balance is due.


3. Cancellations and Refunds


  • Deposit Non-Refundable: The initial 50% deposit is non-refundable under all circumstances. This covers the Artist's time spent in consultation, design, and materials purchased.

  • Client Cancellation: If the Client cancels the commission after the work has begun, the 50% deposit will be forfeited. The Client is not liable for the remaining 50% balance.


4. Copyright and Usage Rights


  • Copyright Retention: The Artist retains the full, exclusive copyright to the commissioned artwork and all preliminary sketches. The Client owns only the physical artwork itself.

  • Artist Usage: The Artist reserves the right to create prints of the commissioned work, use images of the finished work for self-promotion (e.g., website, portfolio, social media), and display the work in galleries or exhibitions.

  • Client Usage: The Client may display the artwork privately and may not reproduce the image digitally or physically for commercial purposes (to sell prints, merchandise, etc.) without explicit written licensing agreement from the Artist.


5. Fulfillment and Shipping


  • Framing Not Included: The final quoted price does not include framing.

  • Liability and Insurance: The Artist is not responsible for damage or loss that occurs once the artwork is shipped. All original artwork is shipped insured, and any claims for damage or loss must be filed by the Client directly with the shipping carrier.
